Moy Place – change of road reserve to legal road
Council asked affected local residents to share their thoughts on a proposal to change a piece of land at the end of Moy Place, Ōtaki, from a Local Purpose Reserve (road) to a legal road.

Background
In 2006, a subdivision created 34 residential lots in what is now Moy Place and Sue Avenue, Ōtaki. Plans showed future development nearby, so a piece of land at the end of Moy Place was set aside as Local Purpose Reserve (road). This land was held by Council under the Reserves Act 1977, in anticipation of converting it to a legal road in the future.
On 15 July 2024, the Environmental Protection Authority (EPA) approved the development at 33 Main Highway, Ōtaki, with access planned through the end of Moy Place, where the Local Purpose Reserve (road) is located. Council received an application to change this reserve land into an official legal road.
Under section 111 of the Reserves Act 1977, land set aside as a road reserve can be dedicated as a road by the local authority if needed. This is done by a resolution and filed with the Registrar-General of Land.
Affected residents invited to have their say
Affected residents were asked to share their thoughts on the proposed change on Wednesday 4 September 2024. The feedback period closed on Wednesday 25 September 2024.
Next steps
Council will hold a hearing on Tuesday 22 October 2024 for those who want to speak about their submissions. You can view the submissions received [PDF 3.77 MB].
Councillors will review the submissions and discuss a report for decision at their Council meeting on Thursday 28 November 2024.
